1. Acceptance of These Terms

These Terms of Service (the "Terms") are a binding agreement between you and PlumberQuickly ("PlumberQuickly," "we," "us," or "our"), the operator of plumberquickly.com (the "Site") and the associated telephone matching and dispatch line (together, the "Service"). By accessing the Site, submitting a request, calling or being connected through our phone line, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

2. Description of the Service — Referral Only

PlumberQuickly is a free referral and lead-matching service. We connect homeowners and other consumers who need plumbing help with independent, third-party plumbing professionals and/or with partners in our plumber and lead-buyer network (each, a "Plumber"). We are a marketing and referral service only. We are not a plumbing contractor, we are not a licensed plumber, and we do not perform, supervise, direct, or control any plumbing work, inspection, estimate, or repair. The Plumbers are independent businesses. They are not our employees, agents, partners, franchisees, or joint venturers, and we do not act on their behalf.

We do not select, dispatch, or recommend any particular Plumber as being suitable for your specific job, and a referral is not an endorsement, certification, or guarantee of any Plumber, their licensing, insurance, workmanship, pricing, or conduct. You are solely responsible for independently verifying any Plumber's license, bonding, insurance, qualifications, reviews, and reputation before hiring, and for deciding whether to hire them. Any contract for plumbing services is solely between you and the Plumber.

3. No Professional Advice

Content on the Site — including articles, checklists, pricing ranges, and troubleshooting tips — is provided for general informational purposes only. It is not plumbing, engineering, safety, legal, or professional advice, and it is not a substitute for the judgment of a licensed professional who has inspected your property. Do not rely on the Site to diagnose or resolve an emergency, a gas issue, a hazardous condition, or a code-compliance question. If you have an emergency, contact the appropriate emergency services or a qualified licensed professional directly.

4. Eligibility and User Responsibilities

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that all information you provide is true, accurate, and your own. You agree to use the Service only for lawful purposes and only to seek plumbing services for a property you own, rent, manage, or are otherwise authorized to arrange service for. You are responsible for evaluating each Plumber, for the terms of any work you authorize, and for your interactions with any Plumber.

5. Consent to Be Contacted; Call Recording (TCPA)

By submitting your information through the Site or our phone line, you expressly authorize PlumberQuickly and the specific Plumber(s) and network partner(s) identified to you at the point of submission to contact you — including at the telephone number you provide — by phone call, text/SMS message, and email, for the purpose of responding to your request and arranging plumbing services. This authorization may include the use of automated dialing technology and prerecorded or artificial voice messages where permitted by law.

You understand that this consent is not a condition of purchasing any goods or services, that message and data rates may apply, and that you may revoke consent at any time — for calls and texts, by replying STOP to a text or asking to be placed on our do-not-call list; for email, by using the unsubscribe link or contacting us. Revoking consent may prevent us from connecting you with a Plumber.

You further acknowledge that calls to and from our dispatch and matching line may be monitored and recorded for quality, training, verification, and compliance purposes, and by continuing with a call you consent to that recording. Do not use the Service if you do not consent.

6. Pricing, Quotes, and Payment

PlumberQuickly is free to you as a consumer; we are compensated by Plumbers and network partners for referrals and connections. Any price, quote, estimate, scope of work, warranty, timeline, or payment term is set and honored solely by the Plumber, not by us. We do not set, collect, guarantee, or refund any amounts you pay a Plumber. You should obtain and confirm all pricing directly with the Plumber, in writing, before authorizing work.

7. Third-Party Plumbers, Links, and Content

The Service may contain links to, or connect you with, third-party websites, businesses, and Plumbers that we do not own or control. We are not responsible for the availability, content, accuracy, products, services, licensing, insurance, safety, or practices of any third party, and your dealings with any third party are solely between you and that third party. Any reviews, ratings, or listings are provided for convenience and may not reflect current or complete information.

8. Disclaimer of Warranties (AS IS)

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, PlumberQuickly DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) any Plumber is licensed, insured, bonded, qualified, available, or will perform satisfactory work; (c) any information provided by a Plumber or on the Site is accurate or complete; or (d) any defect will be corrected. YOU ASSUME FULL RESPONSIBILITY AND RISK FOR YOUR SELECTION OF, AND DEALINGS WITH, ANY PLUMBER. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PlumberQuickly AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO THE SERVICE OR TO ANY PLUMBER'S ACTS, OMISSIONS, WORK, OR CONDUCT, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS (US$100.00). Because PlumberQuickly does not perform plumbing work and only provides referrals, you agree that any claim relating to the quality, safety, cost, or outcome of plumbing work is against the Plumber and not against PlumberQuickly. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless PlumberQuickly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of the Service; (b) your interactions with, hiring of, or disputes with any Plumber; (c) your violation of these Terms or of any law; or (d) any information you submit through the Service.

11. Intellectual Property

The Site and its content — including text, graphics, logos, the PlumberQuickly name and marks, and software — are owned by or licensed to PlumberQuickly and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Site for its intended purpose. You may not copy, reproduce, scrape, resell, or create derivative works from the Site without our prior written permission.

12. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Informal resolution first: Before starting arbitration, you agree to contact us at [email protected] and give us 30 days to try to resolve the dispute informally.

Binding arbitration: Except as noted below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, rather than in court, administered under the rules of a recognized arbitration provider. The arbitrator, and not any court, will decide all issues relating to the scope and enforceability of this arbitration agreement.

Class action waiver: You and PlumberQuickly agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.

Exceptions: Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for intellectual-property misuse or unauthorized access to the Service.

30-day right to opt out: You may opt out of this arbitration and class-waiver provision by sending written notice to [email protected] within 30 days of first accepting these Terms, stating your name and your intent to opt out. Opting out will not affect any other part of these Terms.

Governing law of the arbitration: The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provision described in this Section.

13. Modifications to the Terms or Service

We may update these Terms from time to time. When we do, we will revise the Effective Date above and, where appropriate, provide additional notice. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. We may also modify, suspend, or discontinue any part of the Service at any time without liability.
